Republic Commission for the Protection of Rights in Public Procurement Procedures The procedure for the protection of the rights of tenderers is regulated by the provisions of Articles 204 to 236 of the Law on Public Procurement of the Republic of Serbia (hereinafter: the LPP). Any person interested in participating or participating in the open procedure for the award of a concession has the right to submit a request for the protection of rights to the Republic Commission for the Protection of Rights in Public Procurement Procedures (the Commission). The request for the protection of rights shall be submitted electronically via the Public Procurement Portal simultaneously to the contracting authority and the Republic Commission, whereby the day of submission via the Public Procurement Portal shall be considered the day of receipt. A request for the protection of rights may be submitted throughout the entire public procurement procedure, unless otherwise provided by the LPP, and no later than ten days from the day of publication of the contracting authority’s decision terminating the public procurement procedure. A request for the protection of rights challenging the actions of the contracting authority in connection with the determination of the type of procedure, the content of the public invitation and the tender documentation shall be considered timely if it is received by the contracting authority no later than three days before the expiry of the deadline for the submission of tenders, regardless of the method of delivery. A request for the protection of rights challenging the actions of the contracting authority taken after the expiry of the deadline for the submission of tenders shall be submitted within ten days from the day of publication of the contracting authority’s decision, or from the day of receipt of the decision in cases where publication is not provided for. After the expiry of the deadline for the submission of a request for the protection of rights, the applicant may not supplement the request by stating reasons related to the actions that are the subject of the challenge in the submitted request or by challenging other actions of the contracting authority of which the applicant was or could have been aware before the expiry of the deadline for the submission of the request for the protection of rights, and which the applicant did not raise in the submitted request.
