Legal status and nationality of a Participant, and all parties constituting the Participants, shall have the nationality of an eligible country: a Member State of the EU, Ukraine, Albania, Bosnia and Herzegovina, Kosovo, Montenegro, North Macedonia, Serbia, Georgia, Moldova, the United States of America, the United Kingdom, Canada, Japan and contracting parties to the European Economic Area (EEA). The procurement documents are made available to Participants upon inquiry to the Client. Open procedure. The qualification criteria: 1. Historical Financial Performance for the period of January 2021 - December 2025: Minimum average annual total revenues of EUR 3 400 000 (three million four hundred thousand) equivalent, within the last five (5) financial years (2021, 2022, 2023, 2024 and 2025). 2. Specific Experience from 1st January 2016 to date of submission: Experience in the implementation of consulting engineering contracts involving construction supervision on motorways/ highways/ roads carried out under the FIDIC Conditions of Contract or under equivalent contractual arrangements, in the assignments of a similar scope. For a contract to be considered equivalent to FIDIC, it must include at least the following elements: (i) clearly defined similar roles for the Employer (Client), Engineer, Contractor and DAB (Dispute Adjudication Board), (ii) Supervision Engineer acting on behalf of the Employer, (iii) fair risk allocation, (iv) Dispute Arbitration Board or similar dispute resolution in line with FIDIC principles. Each contract reference must be either completed or substantially completed. The latter being defined as invoicing for at least 80% of the total contract price corresponding to the envisaged scope of services. The proposal shall include supervision of construction works of: a) a minimum of 3 (three) contracts/ references, each with a value of not less than 1,900,000 (one million nine hundred thousand EUR) EURO, covering motorways/ highways/ roads and including of civil works on artificial structures, such as overpasses, and/ or bridges with steel and/or reinforced concrete elements; b) а minimum of 2 (two) separate contracts, the scope of each having included: construction or reconstruction of at least one large bridge, defined for a purpose of this criterion as a bridge with a total length exceeding 100 metres. 3. Management Experience: Experience as a sole consultant or a lead partner in a JVCA in the execution at least two (2) supervision contract of civil works on motorways / highways/ roads with a value equivalent each of at least 1 900 000 (one million nine hundred thousand) EUR. Each such contract implemented by the Participant, that has been completed or substantially completed. To be considered successfully and/ or substantially completed, the Participant shall demonstrate that, for the contract cited as experience at least 80% of the total contract value for the Services was invoiced. This shall be confirmed by an invoice or other payment document verifying that the Services have been provided. The threshold for substantially completed is no less than 80% of the envisaged scope of works measured in invoiced value of services. Time for Completion of the Works - 548 days including preparatory work. Defects Notification Period – 365 days. The Project shall be implemented in accordance with the EIB Group Environmental and Social Policy (https://www.eib.org/en/publications/eib-group-environmental-and-social-policy) and EIB Environmental and Social Standards (https://www.eib.org/files/publications/eib_environmental_and_social_standards_en.pdf). The specific objectives of the Consultancy Services are: 1. to provide contracts administration and engineering supervision services for the Works executed by the Contractors during the construction period and the Defects Notification Period (DNP), starting from the Date of Commencement and continuing through contract commissioning; 2. to support the Employer in managing the Works Contract under the Project, including contractual, administrative, and technical aspects, and to provide expert advice throughout the implementation period; 3. to perform the duties and responsibilities of the “Engineer” under the FIDIC Red Book 1999, with due diligence, impartiality, and professional care, while acting in accordance with the terms of the Contract and in the interest of the Employer; 4. to provide technical supervision during construction, including resolution of technical issues that may arise, and to ensure compliance of the Works with the approved design; 5. to advise the Employer on all matters related to claims and variations submitted by the Contractor, and to provide justified recommendations in line with the Contract provisions. This includes preparation for and participation in procedures involving the DAB, where applicable; 6. to monitor the implementation of the environmental and social requirements set forth in the Project’s Environmental and Social Management Plan (ESMP), and Transport Safety Plan (TSP), and to assist the Employer in fulfilling his obligations in accordance with the EIB environmental and social standards. The Client intends to apply a portion of the available funds to engage a suitably qualified Engineering Consultant (the “Consultant” or the “Engineer”) to provide engineering supervision services for the below described Works, in accordance with the FIDIC Conditions of Contract for Construction (Red Book, 1999 edition). The Works provide for the rehabilitation and strengthening of the road embankment under terrain of complexity of Category I-b and II, with a total length of 742.86 m (right carriageway). The designed total length of the bridge is 216.65 m. This section is located in the village of Mayaki, Mayaki Territorial Community, Odesa district of Odesa region on the route to the Ukrainian-Moldavian border. The public road of national importance M-15 Odesa–Reni (toward Bucharest), with a total length of approximately 295 km, is designated as an international road in accordance with the Resolution of the Cabinet of Ministers of Ukraine of 30 January 2019. The M-15 forms an integral part of Pan-European Transport Corridor IX and the international TRACECA corridor, constituting a key transport axis facilitating international freight and passenger movement between Ukraine, the Republic of Moldova and Romania (the EU).
