See tender specifications for information. The tenderer is obliged to comply with the contracting entity’s labour clause in connection with its performance of the contract. The following grounds for exclusion, cf. the Danish Public Procurement Act, apply to this tendering procedure: • section 135 (1) and (3), • section 136, and • section 137(1), para (2) on bankruptcy etc. For the final and full wording of the abovementioned provisions, see the provisions of the Danish Public Procurement Act. The contracting authority shall also exclude economic operators, which are subject to EU sanctions in accordance with EU regulation 833/2014 with later amendments, Article 5k. Pursuant to the Danish Act on the Complaints Board for Public Procurement, etc. (lov om Klagenævnet for Udbud m.v.) (the Act is available (in Danish) at www.retsinformation.dk) the following deadlines apply to the lodging of complaints regarding procedures covered by Title III of the Danish Public Procurement Act: Complaints of award procedures, see section 7(2) of the Act, must be lodged with the Danish Complaints Board for Public Procurement before the expiry of: 1) 45 calendar days after the contracting entity has published a notice in the Official Journal of the European Union that the contracting entity has entered into a contract. The deadline is calculated from the day after the day when the notice was published. 2) 30 calendar days calculated from the day after the day when the contracting entity has notified the candidates concerned that a contract based on a framework agreement with reopening of competition or a dynamic purchasing system has been entered into if the notification has included an explanation of the relevant grounds for the decision. 3) 6 months after the contracting entity entered into a framework agreement calculated from the day after the day when the contracting entity notified the candidates and tenderers concerned, see section 2(2) of the Act and section 171(4) of the Danish Public Procurement Act. Not later than at the time of lodging a complaint with the Danish Complaints Board for Public Procurement, the complainant must notify the contracting entity in writing that a complaint has been lodged with the Danish Complaints Board for Public Procurement and whether the complaint was lodged during the standstill period, see section 6(4) of the Act. In cases where the complaint was not lodged within the standstill period, the complainant must furthermore indicate whether a suspensory effect of the complaint has been requested, see section 12(1) of the Act. Danish Competition and Consumer Authority The contracting entity has set the following requirements in relation to technical and professional ability: • The tenderer is required to have performed (entered into, ongoing or finalized) minimum two (2) contract within the field of canteen services and meeting catering within the last 3 years. In relation to documentation of technical and professional ability, the tenderer is required to provide the following: The tenderer must fill in a list of minimum 2 and maximum 4 contracts (i.e. from all involved economic operators in a group of economic operators and /or other supporting entities). If a tenderer has listed more than 4 con-tracts, the contracting authority will only read and assess the 4 most recent contracts listed (first based on end date, and then based on start date). Each listed contract should include the following information: • a description of the contract (nature and quantity of services from the tenderer and how they compare to the description of this procurement), • amount (remuneration received by the economic operator for the performance of the services), • start date (date of conclusion of the contract), • end date (date of completion of services), and • recipient (name and contact information). The contracting entity reserves the right to contact the recipients of services or require statements from the recipients, confirming that the tenderer has performed the listed contracts, as documentation in relation to the technical and professional ability. The tenderer must provide the information in the tender letter. The tender procedure is covered by the Danish Public Procurement Act (Act No. 1564 of 15 December 2015 as amended), which implements the Public Procurement Directive (Directive 2014/24/EU). The tenderers are to prepare their tenders on the basis of the tender documents and to submit their tender before expiry of the deadline for submission of tender. In this period, the tenderer may participate in an information meeting. The contracting entity will open and review the tender to verify whether it fulfils the formal requirements of the tendering procedure. The contracting entity will then evaluate the compliant tenders in accordance with the award criterion set out in the tender specifications. The contracting entity will decide on award of the contract and inform the tenderers simultaneously of its decision. See tender specifications for further information about the tendering procedure. Quality The Ministry of Foreign Affairs of Denmark The contracting entity has an option to extend the contract by three (3) times by one (1) year on unchanged terms. The contracting entity's option is exercised by written notice to the supplier within 6 months prior to the expiry of the contract with effect for one (1) year at the time. If the contracting entity does not extend the contract, it will automatically terminate on expiry of the term of the contract. The Danish Complaints Board for Public Procurement Mercell Holding ASA The Ministry of Foreign Affairs of Denmark at the Permanent Representation of Denmark to the European Union (contracting entity) wants to enter into a contract regarding delivery of canteen services and meeting catering. Canteen services concerns delivery of daily food and beverage services for employees and authorised users of the contracting entity's location. Meeting catering include delivery of food and beverage services in support of meetings, workshops, conferences, receptions and internal gatherings. Furthermore, the supplier shall deliver a fruit arrangement and deliver coffee, tea etc. to the contracting entity's coffee stations. The contracting entity operates within a dynamic international environment and serves as Denmark's official diplomatic mission to the European Union. In addition to supporting the daily activities of employees and visitors, the contracting entity regularly hosts official meetings, working lunches, receptions, cultural events and diplomatic engagements involving national and international stakeholders. Hospitality services therefore play an important role in supporting both the operational functioning and the external representation of the contracting entity. The contracting entity seeks a supplier capable of delivering consistently high standards of hospitality while demonstrating professionalism, reliability, flexibility and an understanding of the specific requirements associated with a diplomatic environment. The contracting entity wants to maintain a price level comparable to that of other private and public canteens. The contracting entity will therefore cover wage costs associated with operating the canteen and thereby ensuring advantageous prices in the canteen. See Annex 5 (Supplier’s charges).
