Additional info PROC
Notes on abandonment After in-depth investigations and due to new, unforeseeable developments, the option has arisen of financing the procurement with our own financial resources in the near future, rather than depending on external financing. SBB therefore intends to reassess the requirement and no longer go ahead with the procurement of the rolling stock by means of a lease, but by self-financing. The object of the procurement to be put out to tender in the future therefore differs substantially from the object of the current selective contract award procedure in legal, economic and procurement procedure terms. The decisive differences are, in particular, the bidder group, transfer of title, financing, validity period and residual value risks, price and cost structure, accounting and life cycle costs, term of the contract, risk allocation, etc. According to Art. 43 para. 1 let. f of the Swiss Public Procurement Act (PPA), the party awarding the contract can cancel a contract award procedure if, for example, a substantial change in the goods and services that are the object of the procedure becomes necessary. Likewise, cancellation is always indicated when more advantageous offers can be expected due to changed general conditions. The necessary adjustments impact not only lower-level details but substantial elements of the object of the procurement and therefore necessitate cancellation and recommencement of the procedure. Bidders are not entitled to compensation accord-ing to Art. 43 para. 2 PPA.

Projet d’acquisition «Trains à grande vitesse» – leasing d’exploitation
Simap.ch
