The background is that the Appeals Board for Public Procurements (KOFA) in case 2026/0327 has recently dealt with a case in which Statsbygg had made qualification requirements that the tenderer had to have certification as a staffing company from the Norwegian Labour Inspection Authority. KOFA concluded that the qualification requirement was illegal and that the competition should have been cancelled. The competition for a framework agreement for environmental consultancy (case no. 2026/3001) includes the same qualification requirement that was tested by KOFA in case 2026/0327. Since KOFA found that the qualification requirement was illegal, Statsbygg decided that there was a justifiable reason to cancel the competition.
